Education & Participation Agreement
This Education & Participation Agreement (“Agreement”) is entered into between Jun Tagai (“Instructor,” “Educator,” “Photographer”) and the individual registering for or participating in any educational offering (“Participant,” “You”).
By registering for, attending, or participating in any private session, workshop, mentorship, class, or related educational experience offered by Jun Tagai, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
1. Scope of Agreement
This Agreement applies to all educational offerings, including but not limited to:
• Private lessons or one-on-one sessions
• Workshops, classes, and group instruction
• Mentorships, portfolio reviews, critiques
• In-person and online events
• Any future educational or instructional offerings
2. Educational Purpose Only / No Guarantees
All services provided are educational in nature. No guarantees are made regarding artistic growth, technical skill improvement, professional success, income, or career outcomes. Results vary based on individual effort, experience, and interpretation.
3. Assumption of Risk
You understand that participation may involve physical activity, outdoor environments, travel, weather conditions, and other factors. You voluntarily assume all risks, known or unknown, associated with participation.
4. Release of Liability
To the fullest extent permitted by law, you release, waive, and discharge Jun Tagai, assistants, representatives, contractors, and affiliates from any and all claims, demands, damages, or causes of action arising from participation, including but not limited to personal injury, property damage, loss, emotional distress, or third-party actions, whether arising from negligence or otherwise.
5. Intellectual Property & Use of Materials
All instructional materials, methods, demonstrations, discussions, and content provided remain the intellectual property of Jun Tagai. Recording, copying, reproducing, distributing, or teaching these materials to others is strictly prohibited without prior written consent.
6. Recording & Media Use
Unless explicitly stated otherwise in writing, audio or video recording is not permitted. Photographs or short video clips taken during sessions may be used by Jun Tagai for educational, promotional, or marketing purposes. Participants who do not wish to appear must notify the Instructor in writing prior to the session.
7. Participant Conduct
Participants agree to act respectfully and follow all instructions. Jun Tagai reserves the right to remove any participant for disruptive, unsafe, or inappropriate behavior without refund.
8. Cancellation, Rescheduling & No Refunds
All bookings are final unless otherwise stated in writing. Missed sessions are non-refundable. Rescheduling is subject to availability and discretion. Bookings are non-transferable.
9. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Hawai‘i.
10. Severability
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
11. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior communications or understandings, whether written or oral.
12. Acknowledgment & Consent
By checking the agreement box in the registration form, you confirm that you have read, understand, and voluntarily agree to be legally bound by this Agreement.
